Can an NRI buy property in Mumbai?

Under current FEMA rules NRIs and persons of Indian origin may generally acquire residential and commercial property in India, with agricultural land, plantation property and farmhouses excluded. Confirm your specific status with your chartered accountant before transacting — rules change and individual circumstances differ.

Do I need to come to India to buy?

Not necessarily. A power of attorney drafted for the specific transaction and correctly attested in your country of residence can allow representation at registration. Start the PoA process early, because the attestation sequence is the most common cause of delay.

How do NRIs pay for property in India?

Through normal banking channels — inward remittance or funds held in NRE, NRO or FCNR accounts — not in foreign currency cash. The right account depends on how you intend to hold and eventually repatriate, so decide it with your CA before the first payment.
